Two anonymous sources with knowledge of the investigation say that Smith's blood alcohol level was three times the legal limit.

The two sources spoke in anonymity because they weren't authorized to speak publicly. They claim that Will Smith's blood alcohol level was at a .24 when he was shot and killed in New Orleans. That's three times the legal limit of .08.

Toxicology reports have not been made public yet.

Peter Thomson, an attorney for the Smith family, did not immediately return phone calls after being left messages from NOLA.com seeking comment on toxicology results.

Thomson has previously commented on Smith's inebriation. He said that he was not "inebriated to the point" of not being able to drive.

It is currently unclear if the toxicology results will be presented in a court hearing on June 1st for Cardell Hayes, the man accused of murdering Will Smith and shooting his wife Raquel.
