Benner made the fake gun out of materials that are available to all inmates. It is thought that he was in possession of a handcuff key that he picked up after an officer unknowingly dropped it.

It is believed that Benner was planning on using the handcuff key, and soap gun in a prison break with the help of Treiston Pierron, an inmate being held on an arson charge and several outstanding warrants.

It was reported that Benner, 49, was charged with attempted simple escape while Pierron, 32, was charged with assisting escape.
